Job Description

Perform legal work in the Business and Public Filings Division. Examine and review moderately complex legal documents for compliance with statutory and administrative filing requirements. Answer questions from legal practitioners, legislative branch, and general public regarding statutory duties of the filing office, including filing requirements and administrative rules relating to the documents and applications reviewed by the division. Provide legal support for paraprofessional staff responsible for the appointment of notaries public and the registration of various state regulated business organizations and/or their agents. Provides guidance to staff regarding interpretation and application of statutory filing requirements and agency administrative rules. May assist in the training of others.

Examples of Work Performed
  • Interact with legal community, legislative branch, and general public by written, electronic, telephonic, and personal one-on-one communication regarding the statutory filing requirements for business organization documents, and other registrations and filings made with the division.
  • Draft letters in response to requests for information.
  • Assist staff in responding to requests for public information by drafting special certifications relating to facts ascertainable from records maintained by the division.
  • Perform legal research and draft legal memorandum regarding effect and application of proposed legislation or current statutory provisions.
  • May assist in drafting administrative rules.
  • May assist in dealing with or investigating complaints of alleged violations of laws relating to notaries public, and business organizations and/or their agents, including athlete agents, business opportunities, health spas, credit service organizations, and telephone solicitors.
  • May assist in staff training or in making public presentations.
  • May draft, edit or assist in the drafting and editing of petitions, motions, and other legal documents for use in administrative hearings, and may represent the agency at administrative hearings, as appropriate.
  • Perform related work as assigned.


GENERAL QUALIFICATIONS GUIDELINES. Your application for employment must reflect how you meet each of the following minimum qualifications.

Education: LLB or JD degree from an ABA-approved law school.

Licensure/Certification: License to practice law in Texas.

Experience: Some experience in legal work.

Knowledge, Skills, and Abilities
  • Knowledge of MS Word.
  • Skill in legal research, analysis and writing.
  • Ability to communicate effectively, both orally and in writing.
  • Ability to use legal reference materials, interpret statutes and administrative rules and apply legal principles and rules to filing determinations.
  • Ability to maintain a positive work environment by interacting with public and staff in a cooperative and polite manner.
  • Skill in using a computer and applicable software; appropriate typing skills for preparation of written communications.
  • Ability to travel as requested in connection with agency duties, such as election inspecting.
  • Ability to prioritize and handle multiple tasks or projects simultaneously.
  • Ability to train others.


Preferred Qualifications
  • Knowledge of Texas business organization laws.
  • Knowledge of trademark law.
  • Knowledge of the Texas Administrative Code, and administrative rule-making process.
  • Knowledge of the Texas Public Information Act.
  • Knowledge of MS Access.
  • Knowledge of MS Excel.
  • Knowledge of MS PowerPoint.


A skills tests may be conducted during the interview and a writing sample may be requested.
